Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the JobsiteBids website and application (the “Service”), which is operated by BlueTeem LLC (“BlueTeem,” “JobsiteBids,” “we,” “our,” or “us”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and U.S.-only availability

The Service is offered and directed only to users located in the United States. We make no representation that the Service is appropriate or available for use outside the United States, and you may not use it from a jurisdiction where doing so would be unlawful. You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms, and “you” refers to that organization.

2. Accounts and teams

You must provide accurate information when creating an account and are responsible for safeguarding your credentials and for all activity under your account. If your plan supports team members, you are responsible for your team's use of the Service and for ensuring each member complies with these Terms. Notify us promptly at support@jobsitebids.com of any unauthorized use of your account.

3. Subscriptions, billing, and automatic renewal

Paid plans are offered on a subscription basis and billed in advance on a recurring monthly term. Current prices are shown on our pricing page and are stated in U.S. dollars; you are responsible for any applicable taxes.

Automatic renewal — please read carefully. Unless you cancel before the end of your current term, your subscription will automatically renew for another term of the same length, and we will charge your payment method the then-current price for that plan at the start of each renewal term. We do this so your access continues without interruption. You may cancel at any time from your account billing settings or by emailing support@jobsitebids.com. When you cancel, your subscription will not renew and your access continues through the end of the term you have already paid for. We will provide any renewal or price-change notices required by applicable law.

If we offer a free trial, it requires no payment method and does not automatically convert to a paid plan — your trial simply ends unless you choose to subscribe. Except as required by law (including any cancellation or refund rights under California law), fees already paid are non-refundable, and partial-term cancellations are not prorated.

4. Acceptable use

You agree not to misuse the Service. You will not: access the Service through unauthorized means or attempt to circumvent its access controls or security; scrape, harvest, resell, or redistribute data from the Service except as these Terms expressly permit; interfere with or disrupt the Service or the networks it relies on; reverse engineer or copy the Service; use the Service to build a competing product; or use the Service to violate any applicable law or the rights of others. We may set and enforce reasonable usage limits to protect the Service.

5. Opportunity data

JobsiteBids aggregates and summarizes public-record solicitation data from government sources and generates AI-assisted summaries and structured fields. We work to keep this information accurate and current, but we do not guarantee its accuracy, completeness, or timeliness, and AI-generated summaries may contain errors. You are solely responsible for verifying all bid details — including deadlines, requirements, and bonding — against the official solicitation and source before relying on them. The Service is a research and workflow tool; it is not legal, financial, or bidding advice.

6. Your data and feedback

As between you and us, you retain ownership of the information you submit to the Service (such as your profile, saved searches, and pipeline). You grant us a limited license to host, process, and use that information to operate and improve the Service and as described in our Privacy Policy. If you send us suggestions or feedback, you grant us a perpetual, royalty-free right to use them without restriction or obligation to you.

7. Intellectual property

The Service, including its software, design, and content other than public-record data, is owned by BlueTeem and protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your internal business purposes during your subscription. All rights not expressly granted are reserved.

8. Third-party services

The Service relies on third-party providers and may link to third-party websites or data sources we do not control (including government procurement portals). We are not responsible for third-party services or content, and your use of them may be subject to their own terms.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any opportunity data or summary is accurate or complete.

10. Limitation of liability

To the maximum extent permitted by law, BlueTeem and its officers, members, and employees will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, revenue, data, business, or goodwill, or for any bid you win, lose, or fail to submit, even if advised of the possibility of such damages. Our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (a) the fees you paid to us in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless BlueTeem from any claims, damages, liabilities, and reasonable expenses (including attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

12. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, if necessary to protect the Service or other users, or to comply with law. On termination, your right to use the Service ends; sections that by their nature should survive (including data, IP, disclaimers, liability limits, indemnification, governing law, and dispute resolution) will survive.

13. Governing law

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of California, without regard to its conflict-of-laws rules, and by applicable U.S. federal law. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

14. Dispute resolution

Before filing any claim, you agree to first contact us at legal@jobsitebids.com and attempt to resolve the dispute informally; we will do the same. If we cannot resolve it within 30 days, either party may bring the claim in a court of competent jurisdiction. Except where prohibited by law, any claim must be brought within one year after it arises, or it is permanently barred.

15. Changes to the Service and these Terms

The Service evolves. We may add, change, or remove features, and may modify, suspend, or discontinue any part of the Service at any time. Features identified as beta, preview, or early access are provided as-is for evaluation, may change or be discontinued without notice, and may be subject to additional terms we provide with them.

We may also update these Terms from time to time. Material changes will be communicated through the Service or by email; continued use after the changes take effect constitutes acceptance. If you do not agree to a change, stop using the Service and cancel your subscription.

16. General

These Terms and the documents they reference are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays or failures caused by events beyond its reasonable control. You consent to receive notices and communications from us electronically.
